Driving Offenses and Traffic Violations Lawyers
Serving Hampton, Manchester, and the Seacoast Region of New Hampshire
There is no such thing as a minor driving offense or motor vehicle violation, even if no one was injured. Depending on the circumstances, you could be facing the suspension or revocation of your driver’s license, in addition to fines, points on your driving record, and increased insurance rates. In some cases, you could even be facing time in jail or prison.
If you are a commercial driver, a New Hampshire traffic violation could affect your ability to drive for a living, even if your commercial license is from another state. It’s important to take every violation seriously, and to work with an experienced traffic violations lawyer who can minimize the negative impact of driving offenses on your record and your rights.
Traffic violations lawyers, Amy Beaton and Larissa Kiers, are seasoned litigators with more than 50 years of courtroom experience between them. They are skilled in helping clients navigate a variety of hearings regarding driving violations in New Hampshire. They understand what is on the line if you are unable to drive: your ability to work, attend school or job training, and care for your family. To protect your ability to drive and enjoy your life, contact Beaton & Kiers today.
New Hampshire Motor Vehicle Hearings for Driving Offenses
The traffic violations attorneys of Beaton & Kiers represent clients in all types of DMV hearings regarding driving offenses, including:
- Administrative License Suspension (ALS): If you were arrested for DWI, you may be subject to an administrative license suspension of 180 days or two years, even if you are not found guilty in a criminal court. You have a right to a hearing on the validity of an ALS, but you must request a hearing within 30 days of your arrest or receipt of a notice of suspension.
- Habitual Offender Hearings: New Hampshire drivers who accumulate a certain number of convictions for traffic violations in a five-year period may be certified as habitual offenders. Habitual offenders can face jail or prison time for driving after being certified a habitual offender. Habitual offender status continues until the driver is decertified in writing after a decertification hearing.
- Original License Suspension Hearings: Drivers under 20 years of age may be subject to an original license suspension after only one conviction of a moving violation. An initial suspension is 20 days, and subsequent suspensions are for increasingly long periods: 45 days and 90 days for second and third convictions, respectively.
- Hardship License Hearing: Under some circumstances, drivers whose license has been suspended or revoked can apply for a restricted license to avoid hardship to themselves or their families.
The advocacy of traffic violations lawyers is invaluable when you have been arrested or charged with a driving offense. An attorney can advise you regarding your options and help to negotiate a favorable outcome for you. Critically, an experienced lawyer can represent you at hearings, present evidence, and fight to protect your rights and your ability to drive legally.
