Drug DUI Penalties in New Hampshire

New Hampshire treats drug DWI convictions on equal footing with alcohol DWI convictions. A prior alcohol DWI on your record counts as a prior offense if you’re charged with drug DUI, which can elevate the charge and its consequences significantly. • First offense: Class B misdemeanor, minimum $500 fine, license suspension of nine months to two years, and mandatory completion of an IDCMP screening within 14 days of conviction, a state-mandated substance use evaluation and treatment referral program.
• Second offense: Class A misdemeanor, minimum $750 fine, and a three-year license revocation. Mandatory jail time depends on the timing of the prior offense: at least 60 days if the prior conviction occurred within the past two years (with 30 days suspended upon IDCMP compliance), or at least 17 days if the prior conviction occurred between two and 10 years before the current offense (with 12 days suspended). An ignition interlock device is required following the revocation period.
• Third offense: Minimum $750 fine, a mandatory sentence of not less than 180 consecutive days, and an indefinite license revocation with no eligibility to petition for restoration for at least five years.
