How New Hampshire Law Defines Auto Theft

Not every vehicle-related theft charge works the same way under New Hampshire law. Two separate statutes can apply, and the distinction between them shapes your defense strategy from the start.

Theft by Unauthorized Taking (RSA 637:3)

A rental dispute or a mechanic holding a car longer than authorized can fall here rather than under the general theft statute, which can mean lesser exposure for the client.

How New Hampshire Classifies Auto Theft Penalties

New Hampshire classifies theft offenses by the value of the property involved, and vehicles frequently land at the most serious tier. Under RSA 637:11:

Misdemeanor theft: property value does not exceed $1,000.

Class B felony: value falls between $1,000 and $1,500, or certain statutory factors apply, such as prior theft convictions.

Class A felony: value exceeds $1,500, a firearm was involved, or the defendant was armed with a deadly weapon during the theft.
